Plaintiff’s case:
It’s the plaintiff’s case that the suit land originally belonged to the plaintiff’s now deceased grandfather a one, Arikodi Zedulaki, who was survived by 4 children, including a one, Ojulong Clement (father of the plaintiff and 3rd defendant) who is now also deceased. That the 1st defendant who has been caretaking the estate divided the Suitland and gave portions to the 2nd &3rd defendants only and deprived him of a larger share as the first born, hence this suit to recover the same.
Defendants’ case:
When the case came up on the 11th July, 2023, the plaintiff orally informed court that he is withdrawing the case against her since she had vacated the suit land. She however testified in court as Dw3.
The 1st & 2nd defendants filed separate written statements of defence disputing the claim. The 3rd Defendant did not file a defence.
The defendants, in a nutshell admit that the Suitland indeed originally belonged to the plaintiff’s late grandfather, a one, Arikodi Zedulaki who was survived by 4 children (Arikodi Zeduraki, Ojulong Clement, Akol Reagan, Ikiring Ketty). That before he died, he called D1 together with the clan leadership and distributed his property amongst his said children.
