Plaintiff’s Case:

In his amended plaint, the plaintiff pleaded facts to the effect that; at all material times, he has been the lawful owner of land situated at Kal center, Pakwany parish, Pabbo subcounty, Amuru district, whose total size is 10 acres, having inherited it from his late father, a one, Lino Okot, who had also acquired the same in the 1940’s from a one, Mr. Leri, who is also now deceased.

Defendant’s Case:

The defendant filed an amended written statement of defence denying the entire claim and also filed a counter suit seeking declaratory orders to the effect that he is the rightful owner of the suitland, an order of permanent injunction, eviction order, general damages, interest, cost of the countersuit and any other relief this hon. court may deem it.
