It was the prosecution’s allegation that LAGU DAVID, OROMA WILLIAM GUMA, OTII DAVID ALIAS TUJJA and others still at large, on the 10th day of may, 2023 at Pacilo East Village, Atiak Subcounty in Amuru District willfully and unlawfully destroyed or damaged one grass thatched hut the property of Ocaya Macilino.

When the case came up for hearing in the 24th October, 2023, prosecution informed court that that A2 is now deceased. This Judgment is therefore in respect of A1 and A3.

In attempt to prove the charge, the prosecution called (3) three witnesses.

Having heard all the evidence from the prosecution this court, on the13th November, 2023 ruled that a prima facie case had been established, hence the accused placed to his defence.

Conclusion

In conclusion, therefore, I find that the evidence before me does not establish that tangible property belonging to the complainants was damaged or destroyed. As none was destroyed, the accused couldn’t have participated in the consummation of an offence that was not committed in the first place.
